Terms of Service

This document is a draft before publication and may change.
These Terms of Service ("Terms") set out the conditions for using IMAFUL (the "Service") provided by IMAFUL LAB ("we" or "us"). By using the Service, you ("you" or "user") agree to these Terms and our Privacy Policy.
1. The Service
The Service lets you share everyday moments, as a photo and a short caption, with people you have mutually accepted as friends. Your posts are shown only to your friends.
The Service includes reactions to posts, tagging friends who were with you, one-to-one messages with friends, and a memories view.
The Service is currently provided free of charge.
2. Who can use the Service
- You must be at least 15 years old to use the Service. People under 15 cannot register or use it.
- If you are under 18, you must have permission from a parent or legal guardian to use the Service.
- You must enter your date of birth to register. You cannot change it yourself after registration. If it is wrong, please contact us.
3. Your account
- Register with accurate information and keep your account secure. Do not let anyone else use or know your login details.
- Your account is for you only. You may not transfer, lend or sell it.
- If you think your account has been used without permission, contact us promptly.
4. Posts, profiles and messages
- You (or the rightful owner) keep the rights to the photos, text, profile information and other content you post or send on the Service ("your content"). They do not transfer to us.
- You grant us a free license to use your content (including copying, storing and processing it for display) to the extent needed to provide the Service (including showing, storing and delivering it to the people you choose), to keep the Service safe and respond to reports, and to comply with the law. We do not use your content for any other purpose.
- You confirm that you have the rights needed for your content and that it does not infringe anyone else’s rights. Please be considerate when you tag friends or post photos that show other people.
- Posts are shown only to your friends, but a friend could still save their screen and share it elsewhere. Please think about what you share.
5. Prohibited conduct
You must not do any of the following. Our Community Guidelines give more specific examples.
- Harass, threaten, attack on the basis of identity, or stalk other users
- Impersonate others or register in a misleading way
- Share or send other people’s personal information (such as addresses or contact details) without their consent
- Post inappropriate images, such as obscene, violent or gruesome images
- Post or send content involving the sexual exploitation or abuse of children, or put minors at risk
- Post or send illegal content or engage in conduct that leads to crime
- Infringe copyrights, portrait rights, privacy or other rights of others
- Send spam, advertising, solicitations or large volumes of the same content
- Gain unauthorized access, attack the Service or other users, or interfere with its operation
- Use someone else’s account, or buy, sell, lend or borrow accounts
- Any other conduct that violates the law or public order and morals, or harms the safety of the Service
6. Reporting and blocking
- You can report posts, messages and users that violate these Terms using the in-app report feature. The person you report is not told who reported them.
- You can block other users. They are not notified that you blocked them.
- To handle reports, we review reported posts, profiles, messages and similar content as needed. For a reported message, we may keep and review a copy of the message as it was when it was reported. We do not routinely read messages.
7. Action on violations
If we decide that you have violated, or may have violated, these Terms, we may hide or remove your content, limit your use of all or part of the Service, or suspend your account. Where required by law, we may provide information to the relevant authorities.
8. Deleting your account
- You can request account deletion in the app under Settings > Delete account, or from our account deletion web page.
- Once you request deletion, your profile and posts are immediately hidden from other users.
- There is a 30-day grace period after your request. If you log in to the same account during this period, you can cancel the deletion and restore your account.
- After 30 days, we permanently delete your account and associated data. Once permanently deleted, it cannot be restored.
- When your account is permanently deleted, the message conversations you took part in are deleted as whole conversations, including for the other person.
- We may keep minimal records needed to handle reports, prevent abuse and comply with the law, in a form that does not identify you, for a period of time. Details are in our Privacy Policy.
9. Changes to, suspension or end of the Service
We may change the Service, or suspend or end it, as needed. If we end the Service, we will try to let you know in advance in the app or by other means.
10. Disclaimer
- We do not guarantee that the Service will fit your particular purpose, always be available or be free of bugs.
- Please resolve interactions and disputes between users among yourselves. We will respond to reports and take other action as needed.
- We are not liable for damage you suffer in connection with the Service, except where caused by our intentional misconduct or gross negligence.
11. Intellectual property
The rights to the Service’s software, design, logos and other materials (other than your content) belong to us or the rightful owners.
12. Changes to these Terms
We may change these Terms as needed. When we do, we will tell you what is changing and when, in the app or by other means. For important changes, we may ask for your agreement again.
13. Governing law and jurisdiction
These Terms are governed by the laws of Japan. the Sapporo District Court or the Sapporo Summary Court has exclusive jurisdiction as the court of first instance for disputes relating to the Service.
